These Terms and Conditions govern the use of limousine rental services provided by Ballston Limousine to their customers. By booking and utilizing our Services, you agree to comply with and be bound by these Terms. Please read them carefully.
**1. Booking and Reservations:**
1.1. Reservations for our limousine services can be made through our website, phone, or in-person.
1.2. All reservations are subject to availability.
1.3. Full payment, or down payment is due at the time of reservation depending on the type and amount of service.
1.4 By renting a vehicle from Us, You agree to be bound by these Terms and Conditions.
1.5 The rental agreement is between the Company and the Customer named in the agreement.
1.6 Reservations must be made 48 hours in advance.
**2. Cancellation and Refunds:**
2.1. Cancellation requests must be made at least 24-48 hours prior to the scheduled pick up time.
2.1.1 Transfer Service Cancellation requires 24 hour notice prior to the scheduled pick up time.
2.1.2 All other services require 48 hours notice of cancellation prior to the scheduled pick up time.
2.2. Cancellations made outside of the specified timeframe will result in forfeiture of your full payment.
2.3. Refunds, if applicable, will be processed within 24 hours in accordance with our refund policy.
**3. Payment:**
3.1 Payment for the service is due in full at the time of booking, unless otherwise agreed upon.
3.2 Additional charges may apply for extra services or extended rental duration, and will be communicated to you prior to the commencement of the rental period.
**4. Service Terms:**
4.1. Our vehicles will be provided in clean and well-maintained condition.
4.2. Customers are responsible for any damage caused to the vehicle by themselves or their guests during the rental period.
4.3. Smoking, consumption of alcohol, and illegal substances are strictly prohibited inside the limousine. A cleaning fee will be charged if this policy is violated.
4.4. The maximum passenger capacity of each vehicle must be adhered to at all times.
4.5. Our chauffeurs are experienced professionals who will adhere to all traffic laws and safety regulations.
4.6. Ballston Limousine, its staff, or chauffeurs will not be responsible for any delays due to accidents, traffic, weather conditions, or any other causes beyond its control.
4.7. In case of liquids spilled causing soiling or damage to the vehicle, a clean-up fee in the amount of $200 will be charged on the credit card.
4.8. Our staff reserves the right to refuse service to any passenger for any type of misbehavior or insobriety.
**5. Liability and Indemnity:**
5.1. Ballston Limousine shall not be liable for any loss, damage, or injury arising from the use of our Services, except where such loss, damage, or injury is directly caused by our negligence.
5.2. Customers agree to indemnify and hold harmless the Company and its affiliates from any claims, liabilities, damages, or expenses arising out of the use of our Services.
**6. Amendments and Modifications:**
6.1. We reserve the right to modify or amend these Terms at any time without prior notice.
6.2. Any changes to these Terms will be effective immediately upon posting on our website.
**7. Governing Law:**
7.1. These Terms shall be governed by and construed in accordance with the laws of The United States District Court for the Eastern District of Virginia.
7.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of The United States District Court for the Eastern District of Virginia.
**8. Severability:**
8.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
**9. Termination:**
9.1 We reserve the right to terminate the rental agreement at any time if the Customer violates any of these Terms and Conditions.
9.2 In the event of termination, no refunds will be provided, and the Customer may be liable for any damages incurred.
Disclaimer:
Ballston Limousine shall not be legally responsible for any direct, indirect, incidental, special, or consequential damages of any kind, etc. This includes attorney’s fees and lost income or funds in any way due to, resulting from, or arising in connection with the service provided, without limitation, which includes its contract and any contract assessed through Ballston Limousine’s office, use of that contract, or display or performance of any agreement, despite of any neglectfulness by any organization or party.
